Please read these Terms of Service (collectively with NRKGO’s Privacy Policy and DMCA Copyright Policy below, the “Terms of Service”) fully and carefully before using nrkgo.com (the “Website”) or any of the services, features, Content or applications made available by NRKGO (collectively, the “Services”). These Terms of Service set forth the legally binding terms and conditions for your use of the Services.
Acceptance of the Agreement
This Agreement consists of the following terms and conditions (hereinafter the “General Terms”) and terms and conditions, if any, specific to use of individual Services (hereinafter the “Service Specific Terms”). In the event of a conflict between the General Terms and Service Specific Terms, the Service Specific Terms shall prevail.
By registering for and/or using any of the Services in any manner, you agree to these Terms of Service and all other operating rules, policies and procedures that may be published from time to time by NRKGO. Arbitration Notice: YOU AGREE THAT DISPUTES BETWEEN YOU AND NRKGO WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION AND YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR JURY TRIAL.
Description of Service
NRKGO provides cloud software and applications for modern developers, including associated offline and browser extensions (Smart Form Filler, API Sniffer Pro, SEO Pro Debugger, CORS Helper). You may use the Services for your personal and business use or for internal business purposes in the organization that you represent. You are responsible for obtaining access to the Internet and the equipment necessary to use the Services.
Beta Service
NRKGO may offer certain Services as closed or open beta services ("Beta Service" or “Beta Services”) for the purpose of testing and evaluation. You agree that we have the sole authority and discretion to determine the period of time for testing and evaluation of Beta Services. NRKGO reserve the right to fully or partially discontinue any Beta Services with or without notice to you. You agree that NRKGO will not be liable to you or to any third party for any harm related to, arising out of, or caused by the modification, suspension or discontinuance of any of the Beta Services.
Free Trial
If you register for a free trial of one or more Services, NRKGO will make the applicable Services available until the end of the trial period. Any data that you enter into the Services, and any customizations made during the free trial will be permanently lost unless you purchase a paid subscription plan or export such data before the end of the trial. Services are offered as-is during the free trial, without any warranty whatsoever.
User Sign up Obligations
You need to sign up for a user account by providing all required information. If you represent an organization, we recommend that you use your corporate email address. You agree to: (i) provide true, accurate, current and complete information about yourself; and (ii) maintain and promptly update your information to keep it accurate. If you provide any information that is untrue, inaccurate, or incomplete, NRKGO may terminate your user account and refuse current or future use of any or all of the Services.
Organization Accounts and Administrators
When you sign up for an account for your organization, you may specify one or more administrators who manage the Services and end users. You are responsible for: (i) ensuring confidentiality of your organization account password; (ii) appointing competent individuals as administrators; and (iii) ensuring all activities comply with this Agreement. You understand that NRKGO is not responsible for account administration and internal management of the Services for you.
Restrictions on Use
In addition to all other terms, you shall not:
- Transfer the Services or otherwise make it available to any third party.
- Provide any service based on the Services without prior written permission.
- Allow user licenses to be shared or used by more than one individual.
- Except as permitted by law, attempt to disassemble, reverse engineer or decompile the Services.
- Use third party links without agreeing to their terms.
- Attempt to gain unauthorized access to the Services or its related systems or network.
- Use the Services in any manner that could damage, disable, overburden, or harm any server, network, or resource of NRKGO.
- Use the Services to send or store material containing software viruses, worms or other harmful code.
- Host, display, upload, modify, or share any information that belongs to another person and to which you do not have any right.
- Use our Services in any manner that threatens the unity, integrity, defence, security or sovereignty of India, or public order.
- Create a false identity to mislead any person as to the identity or origin of any communication.
- Use the Services for competitive or benchmarking purposes.
Spamming and Illegal Activities
You agree not to use the Services for illegal purposes or for the transmission of material that is unlawful, defamatory, harassing, libelous, invasive of another's privacy, abusive, threatening, harmful, vulgar, or obscene. You agree not to use the Services for the transmission of "junk mail", "spam", "chain letters", “phishing” or unsolicited mass distribution of email.
Communications from NRKGO
The Service may include certain communications from NRKGO, such as service announcements, administrative messages and newsletters. These communications shall be considered part of using the Services. We provide you the option of opting out from receiving newsletters; however, you will not be able to opt-out from receiving service announcements and administrative messages.
Complaints Procedure
If we receive a complaint from any person with respect to your activities as part of use of the Services, we will forward the complaint to your primary email address. You must respond to the complainant directly within 10 days of receiving the forwarded complaint and copy NRKGO in the communication. Failure to respond within 10 days will be construed as your consent to disclosure of your name and contact information by NRKGO to the complainant.
Inactive User Accounts Policy
We reserve the right to terminate unpaid user accounts that are inactive for a continuous period of 120 days. In the event of such termination, all data associated with such user account will be deleted. We will provide you prior notice of such termination. Each Service will be considered an independent and separate service for the purpose of calculating the period of inactivity.
Hosting Location
The destination of your cloud facility depends on the mapping of your region/country at the time of sign-up. We may migrate your account to a different facility in the event of platform updates. You must not mask your internet protocol (IP) address at the time of sign-up. If your actual region is found to be different from our records, NRKGO may migrate or close your account.
Data Ownership
We respect your right to ownership of content created or stored by you. NRKGO does not claim a license to use, reproduce, modify, or distribute your content for commercial/marketing purposes unless specifically permitted by you. You grant NRKGO permission to access, copy, and display your content solely as required to provide the Services to you.
Sample Files and Applications
NRKGO may provide sample files and applications for demonstration purposes. These files consist of random data. NRKGO makes no warranty, either express or implied, as to the accuracy, completeness or reliability of the information in sample files.
Trademark
NRKGO, NRKGO logo, the names of individual Services and their logos are trademarks of NRKGO Ecosystem. You agree not to display or use NRKGO trademarks in any manner without prior permission.
Disclaimer of Warranties
YOU EXPRESSLY UNDERSTAND AND AGREE THAT THE USE OF THE SERVICES IS AT YOUR SOLE RISK. THE SERVICES ARE PROVIDED ON AN AS-IS-AND-AS-AVAILABLE BASIS. NRKGO EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. NRKGO MAKES NO WARRANTY THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE.
Limitation of Liability
YOU AGREE THAT NRKGO SHALL, IN NO EVENT, BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL, PUNITIVE, OR OTHER LOSS OR DAMAGE WHATSOEVER INCLUDING LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, COMPUTER FAILURE, OR LOSS OF DATA. IN NO EVENT SHALL NRKGO’S ENTIRE LIABILITY TO YOU EXCEED FIFTY THOUSAND RUPEES (₹ 50,000) OR THE FEES PAID BY YOU DURING THE TWELVE (12) MONTHS PRIOR TO THE EVENT, WHICHEVER IS HIGHER.
Indemnification
You agree to indemnify and hold harmless NRKGO, its officers, directors, and affiliates from and against any losses, damages, fines and expenses (including attorney's fees) arising out of claims that you have used the Services in violation of another party's rights, any law, or any provisions of the Agreement.
Governing Law and Jurisdiction
Any controversy or claim arising out of or relating to the Terms shall be settled and adjudicated exclusively by the competent courts of India in accordance with the laws of India.
Modification of Terms of Service
We may modify this Agreement upon notice to you at any time through a service announcement or by sending email. If we make significant changes that affect your rights, you will be provided with at least 30 days advance notice. Your continued use of the Service after the effective date of any change will be deemed to be your agreement to the modified Agreement.
